1. Acceptance of Terms

By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. We reserve the right to modify, update, or revise these Terms at any time, with changes becoming effective upon posting to the App. Your continued use of the App following any changes signifies your acceptance of the revised Terms.

2. Eligibility

• You must be at least 18 years old to use the App.
• By using the App, you represent and warrant that you meet the minimum age requirement and have the legal capacity to enter into a binding contract.

3. Account Registration

Creating an Account — To access certain features (e.g., booking, listing), you must create a user account. You agree to provide accurate, current, and complete information and to promptly update this information as necessary.

Responsibility for Account — You are solely responsible for maintaining the confidentiality of your login credentials and for any and all activities that occur under your account.

Unauthorized Access — You must immediately notify Nuzul if you suspect any unauthorized use of your account or any other security breach.

4. Services Provided

Nuzul acts solely as an intermediary by connecting Guests with Hosts. We do not own, control, manage, or operate any of the accommodations or services listed on the App. All bookings are direct transactions between the Guest and the Host.

5. User Responsibilities

Guests — You agree to use the App to request and book accommodations or services in compliance with applicable laws and regulations, provide accurate information when booking, and respect house rules or service guidelines set by the Host.

Hosts — You agree to list accurate and honest details about your accommodations or services, maintain quality, safety, and compliance with local laws, and honor confirmed bookings with prompt communication.

Prohibited Conduct — Users must not engage in fraudulent, illegal, or abusive activities, including impersonation, harassment, posting misleading information, or violating any intellectual property rights.

6. Booking and Payment

Booking — Once a Guest makes a booking request, it is subject to the Host's confirmation. All communications related to bookings should go through the App's messaging system.

Payment — Payment is facilitated through a third-party payment processor. Nuzul may charge service fees for facilitating transactions; such fees will be disclosed before booking or listing.

Cancellation and Refunds — Each Host sets their own cancellation policy, presented to the Guest at the time of booking. Nuzul may assist in dispute resolution but is not responsible for issuing refunds unless explicitly stated in the Host's terms or required by applicable law.

7. User Reviews and Ratings

After a completed stay or service, Guests and Hosts may leave reviews and ratings for each other. Reviews should be truthful, respectful, and relevant to the booking experience. Nuzul reserves the right to remove or moderate reviews that are abusive, off-topic, fake, or violate our guidelines.

8. Privacy and Data Protection

Your use of the App is governed by our Privacy Policy, which describes how we collect, use, and share personal information. By using the App, you consent to our data practices as outlined in the Privacy Policy.

9. Intellectual Property

The App (including text, graphics, logos, and software) is the exclusive property of Nuzul or its licensors. You may not copy, modify, distribute, display, publish, or create derivative works of any content from the App without our prior written permission.

10. Disclaimers and Limitation of Liability

No Warranty — Nuzul provides the App "as is" without warranties or guarantees of any kind, whether express or implied. We do not guarantee the accuracy, reliability, or availability of listings or services provided by Hosts.

Limitation of Liability — Under no circumstances shall Nuzul be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits. Our total liability to you for any claims shall not exceed the amount paid by you (if any) for using the App in the twelve (12) months preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Nuzul, its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use or misuse of the App, your violation of these Terms, or your infringement of any rights of a third party.

12. Termination

• Nuzul may, in its sole discretion, suspend or terminate your account if you violate these Terms or engage in fraudulent, illegal, or harmful conduct.
• You may terminate your account at any time by contacting Nuzul support. Upon termination, your right to use the App immediately ceases.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Oman, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts of Oman for any legal matter arising from or related to these Terms.

14. Dispute Resolution

Unless prohibited by law, any dispute arising out of or relating to these Terms shall be resolved through binding arbitration in Oman, conducted on an individual basis and not as part of a class action or consolidated proceeding.

15. Force Majeure

Nuzul shall not be liable for any delay or failure in performing its obligations under these Terms if such delay or failure results from events beyond its reasonable control, including but not limited to acts of God, wars, natural disasters, or technical failures.
